General Terms and Conditions

Article 1 – Definitions
Consumer: a natural person who does not act in the exercise of a profession or business and who enters into an Agreement with G&G Bike Nederland.
G&G Bike Nederland: the provider of products and user of these general terms and conditions within the meaning of the Civil Code.
Right of withdrawal: the Consumer's right to cancel the Distance Purchase within the reflection period.
Customer: the Customer who enters into an Agreement with G&G Bike Nederland for the purchase of products.
Distance Purchase: an Agreement in which, within a system organized by G&G Bike Nederland for the distance sale of products, one or more distance communication techniques are used exclusively up to and including the conclusion of the Agreement.
Agreement: a purchase agreement concluded between the Parties.
Parties: G&G Bike Nederland and its Customer collectively.
Distance communication technique: means that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same place at the same time.

Article 3 – Applicability
1. These general terms and conditions form an integral part of the Agreement between the parties.
2. Deviations are only valid if confirmed in writing (email is considered written).
3. Other general or specific conditions are expressly rejected, unless otherwise agreed in writing.
4. If one or more provisions are wholly or partially null or voided, the remaining provisions shall remain in full force.
5. In case of conflict between these terms and specific product or service conditions, the specific conditions take precedence.
Article 4 – Offer
1. All offers are without obligation and can be revoked at any time, unless otherwise stated.
2. An offer is only valid if it is sufficiently detailed to allow the Customer to assess the offer. Obvious mistakes and errors do not bind G&G Bike Nederland.
3. Offers are valid while supplies last. Displayed quantities are indicative.
Article 5 – Acceptance and Conclusion of Agreement
1. The Agreement is concluded at the moment the Customer accepts an offer from G&G Bike Nederland and this acceptance is received by G&G Bike Nederland, for example by placing an order via the webshop.
2. Another form of acceptance (by email or phone) is only valid if confirmed in writing by G&G Bike Nederland.
3. Within legal frameworks, G&G Bike Nederland may investigate the Customer’s creditworthiness and refuse orders or execute them under special conditions if there is reason to do so.
Article 6 – Cancellation
A Customer who is a Consumer can cancel an order until G&G Bike Nederland has confirmed the order. When the Right of Withdrawal applies, the Customer can also withdraw from the purchase after confirmation according to article 14.
Article 7 – Prices
1. Prices will not be adjusted after the Agreement is concluded, unless required by legal measures (such as VAT increases).
2. All prices are stated in euros, including VAT and excluding shipping costs, unless otherwise indicated. The total price is displayed before finalizing the order.
Article 8 – Payments
1. Payment is made via the payment methods listed on the website or by bank transfer, as specified in article 2.
2. Unless otherwise agreed, payment must be made in full within 14 calendar days after purchase.
3. If prepayment is required from a Consumer, it amounts to a maximum of 50% of the total purchase price.
Article 9 – Payment Arrears
1. If the Customer does not pay within the agreed period, they are automatically in default after the deadline and statutory interest is due.
2. Payments after default are first applied to costs, then to interest, and finally to the principal amount.
3. G&G Bike Nederland may refuse payment if the Customer wants to change the order of set-off.
Article 10 – Extrajudicial Collection Costs
1. For Consumers, the statutory collection costs scheme applies (15% on amounts up to €2,500, etc.).
2. For business customers, collection costs of 15% of the principal amount apply, with a minimum of €75 per invoice.
Article 11 – Interest
1. For Consumers, the statutory interest rate applies.
2. For business customers, 1.5% per month applies, unless the statutory interest rate is higher.
Article 12 – Delivery
1. Pickup is only possible by appointment.
2. Delivery times are indicative. Consumers receive their order within 30 days, unless otherwise communicated.
3. If the period is exceeded, the Consumer may cancel the Agreement free of charge, except for custom-made products and only in consultation.
4. The risk of damage or loss rests with G&G Bike Nederland until delivery to the Customer.
Article 13 – Complaints (Non-Conformity)
1. The Customer must inspect goods immediately upon receipt and report any defects within a reasonable time. For Consumers, the reporting period is a maximum of 2 months after discovery.
2. In case of non-conformity, G&G Bike Nederland will either replace the product or offer a (partial) refund at its discretion.
3. No right to compensation exists for damage caused by misuse, own modification, or negligence.
4. Returns are at the Customer's own risk and expense.
Article 14 – Right of Withdrawal
1. Only applicable to Consumers.
2. The Consumer may cancel the purchase without reason within 14 days of receipt.
3. The period starts the day after receipt of the (last) product.
4. After notification, the product must be returned within 14 days.
5. Costs and risks of return are borne by the Consumer.
6. In case of a full return, the Consumer will receive the full purchase amount, excluding shipping costs. Shipping costs are a provided service and are not reimbursed.
7. Products must be returned unused and undamaged in their original packaging.
8. Exceptions are listed in article 15.
Article 15 – Exceptions to the Right of Withdrawal
1. Products manufactured according to the Customer’s specifications (custom-made) are excluded.
2. Opened sealed software or audio/video recordings cannot be returned.
3. Also excluded are products that spoil quickly, age, or are personal in nature.
Article 16 – Refunds
1. Refunds are made within 10 working days after cancellation via the same payment method.
2. Upon withdrawal, G&G Bike Nederland may wait to refund until the product has been returned.
Article 17 – Warranty and conformity
1. The statutory warranty and factory warranty apply.
2. G&G Bike Nederland guarantees that its products comply with the Agreement, reasonable standards of quality, and applicable legislation.
3. Any additional warranty does not affect the Consumer’s statutory rights.
Article 18 – Complaints
1. Complaints can be submitted via the complaint form on the website.
2. Consumers can also use the European ODR platform: ec.europa.eu/odr.
3. G&G Bike Nederland responds within 14 days. If more time is needed, this will be communicated within that period.
Article 19 – Limited liability
1. G&G Bike Nederland is not liable for damage caused by misuse or incorrect information.
2. Only direct damage is eligible for compensation; no consequential damage or loss of profit.
3. The maximum liability is limited to the invoice amount or €50,000, whichever is lower.
4. An exception applies in cases of intent or gross negligence on the part of G&G Bike Nederland.
Article 20 – Retention of title
1. All delivered goods remain the property of G&G Bike Nederland until full payment has been received.
2. The Customer may not pledge the goods or use them as payment.
3. The Customer is obliged to insure the goods against damage and theft.
4. G&G Bike Nederland may repossess the goods in case of non-compliance with obligations.
Article 21 – Applicable law and competent court
1. Dutch law applies to all Agreements.
2. Disputes shall be submitted to the competent court in The Hague, unless otherwise agreed.
